The Terms of Operation outlined below are applicable to the provision of Recruitment Services from Working Smart Limited (WSL). Agreement to these Terms of Operation does not constitute a contract between WSL and the ‘Client’ at this time. Following your agreement, WSL will review your registration and contact you. |
- Definitions
- Web site refers to the Graduate Smart Web site at www.graduate-smart.com
- WSL refers to Working Smart Limited.
- Client refers to the Employee's employer.
- Employee refers to a company representative who has registered with WSL to avail of recruitment services.
- Services refers to the provision of our Online Recruitment Services only.
- Login Details refers to permissions provided by WSL that enable Client/Employee access to Services.
- Copyright
- Copyright of this Web site is solely owned by WSL.
- The contents of this Web site may not be copied, reproduced, or distributed in any form whatsoever, or by any means, without the express written permission of WSL.
- You may only print (or download to disk) the contents of this Web site for the purpose of your organisational use, in relation to the services you have been allocated (i.e. CV Summary Report, Job Management Reports, Client Posted Jobs).
- Obligations
- The Employee warrants that they are an Employee of the Client and that they have the right to register and act as a Client representative on behalf of the Client. This is important as financial implications apply.
- The Client undertakes to ensure that all information provided for our Web site is, in all respects, true and accurate and not misleading or deceptive and they shall indemnify WSL in respect of any failure to do this.
- The Client is responsible and liable for any material posted to our Web site and will ensure that it contains no material that is offensive, discriminatory, obscene, defamatory or otherwise unlawful.
- The Client is responsible and liable for the content of jobs they post to our Web site and will ensure that it contains no material that is discriminatory or otherwise unlawful
- The Client is responsible for keeping safe their Login Details and must not disclose their Login Details to any third party. Failure to comply will result in immediate withdrawal of services. It may also result in prosecution.
- The Client shall keep confidential all information obtained from WSL pursuant to a contract being in-place nor shall they divulge information to any third party without the written consent of WSL. The Client shall ensure that their servants, agents, employees and sub-contractors are bound by the provisions of this clause before, during and after the provision of Service.
- The Client consents to information about them being collected, held and disclosed by WSL in the provision of our Services.
- The Client must inform WSL immediately if the Employee no longer works for the Client.
- Data Protection
- The Client agrees to comply with the provisions of the UK Data Protection Act 1998 or relevant legislation of your registered country of operation.
- Liability Exclusion
- WSL does not accept liability of any description, or any damages or losses (including, but without limitation to, indirect or consequential loss, or loss of business, revenue, profits, use or opportunity) howsoever resulting from the use or non-use of our Web site.
- WSL has taken every care to ensure the accuracy and completeness of the contents of this Web site. WSL accepts no responsibility as to the accuracy, completeness or fitness for purpose of any material on, or the reliability of access to this Web site (or any web site that is, or may become, linked to this Web site) or for keeping material up-to-date or any liability resulting from its failure to do so.
- WSL reserves the right, at its discretion, to remove Client material.
- Judicial System
- These Terms of Operation shall, in all respects be governed by and construed in accordance with the provisions of the Laws of England and Wales. Both Parties to the Contract submit to the jurisdiction of the English Courts.
- Revisions
- WSL reserves the right to modify these Terms of Operation at any time.
